The Waubay City Council met August 4, 2014 at City Hall at 6:30pm. Mayor Jens presided with Councilmembers Berger, Grebel, Jorgenson, Moen, Rumpza in attendance. Others attending: Erika Welch, Curtis Neilan, Dwayne and Dorothy Eidet, Curt and Phyllis Koepp, Mary Hoines, Rosanne Bisgard, Dennis Gregerson, Devlin Benike, Scott Mohror. 

Motion to approve minutes from July 7, 2014 was made by Berger, second by Jorgenson, motion carried.

Library reported 398 visitors, summer reading auction will be held August 11, estimate to paint walls from 3D Painting and Drywall in amount of $250.00. Motion to approve estimate from 3D Painting and Drywall for $250.00 was made by Moen, second by Grebel, motion carried. Motion to approve report was made by Rumpza, second by Grebel, motion carried.

Maintenance department reported lift station inspections done, replaced one wear ring, need to replace impellors at lift 8. Motion to approve replacing impellors at lift station 8 was made by Grebel, second by Berger, all voting aye, motion carried. Council requested that work on garage by water tower be finished and county shed be repaired and painted. Customer making water line repair found curb stop was bad, according to ordinance these repairs are City responsibility. Contractor said most cities have homeowners responsible from main to house, not curb stop to house. Will check into ordinance and see what other cities do. Motion by Grebel, second by Rumpza, to fine resident $200.00 for discharging sump pump into sewer system, motion carried. Motion to approve report was made by Moen, second by Jorgenson, motion carried.

Community Access Grant – The following bids were received at bid opening on July 15:
          Asphalt Paving & Materials Co. - $195,166.02
          Bituminous Paving, Inc.  - $218,178.35
          Lien Transportation & Construction - $260,782.37
Motion to award bid to Asphalt Paving & Materials Co. in the amount of $195,166.02 contingent on SD Department of Transportation approval was made by Moen, second by Jorgenson, all voting aye, motion carried. 

FEMA Lagoon Project – State received notification that project has been approved for the Public Assistance Alternative Procedures Pilot Program. City is awarded $415,820.00 for the spring 2011 flooding event. Motion to accept award of $415,820.00 was made by Grebel, second by Berger, all voting aye, motion carried. Need to get on State Water Plan in October, need cost estimate updated. 

Surplus lots auction was held August 1, 2014 at 5:00pm at City Hall. Motion was made by Moen to accept bid in amount of $6000.00 from Robert Grebel for West 75’ of Lots 21 and 22 and all of Lot 23, Block 9, Original Plat, second by Jorgenson, Grebel abstaining, all voting aye, motion carried. Motion to accept bid in amount of $1000.00 from Jason Benike for Lots 12, 13, 14, Block 9, Original Plat was made by Jorgenson, second by Berger, all voting aye, motion carried. Motion to reject bids in the amount of $500.00 for Lot 1 and $250.00 each for Lots 2, 3, 4, 5, East Railway First Addition from Mike Hoven was made by Grebel, second by Jorgenson, all voting aye, motion carried.


City Park Playground Equipment – Company still offering set at same discount as last year, will place on September agenda. LWCF grant deadline is September 5. Motion to approve the following resolution was made by Grebel, second by Rumpza, all voting aye, motion carried, resolution as follows:
WHEREAS, the United States of America and the State of South Dakota have authorized the making of grants from the Land and Water Conservation Fund (LWCF) to public bodies to aid in financing the acquisition and/or construction of specific public outdoor recreation projects;
NOW THEREFORE BE IT RESOLVED:
1. That Mayor Kevin Jens is hereby authorized to execute and file an application on behalf of the City of Waubay with the National Park Services, U.S. Department of the Interior, through the State of South Dakota, Department of Game, Fish and Parks, Division of Parks and Recreation, for an LWCF grant to aid in financing Surma Jackson Memorial Park, Playground Improvements for the City of Waubay, South Dakota and its Environs.
2. That Kevin Jens, Mayor, is hereby authorized and directed to furnish such information as the above mentioned federal and/or state agencies may reasonably request in connection with the application which is hereby authorized to be filed.
3. That the City of Waubay shall provide a minimum of 50% of the total cost of the project; and will assume all responsibility in the operation and maintenance of the project upon completion of construction, for the reasonable life expectancy of the facility.
The undersigned duly qualified and acting Finance Officer of the City of Waubay does hereby certify: that the attached Resolution is a true and correct copy of the Resolution, authorizing the filing of application with the National Park Service as regularly adopted at a legally convened meeting of the City of Waubay duly held on the 4th day of August, 2014, and further that such Resolution has been fully recorded in the journal of proceedings and records in my office. Motion to approve an automatic supplement in amount of $2882.00 due to grant funds for mosquito control was made by Berger, second by Moen, all voting aye, motion carried. 

HMGP – Motion by Rumpza to approve an automatic supplement in amount of $15,000.00 due to grant funds, second by Jorgenson, all voting aye, motion carried. Motion to approve an invoice in amount of $2550.00 from NECOG for administration costs was made by Rumpza, second by Grebel, all voting aye, motion carried. 

Blue Dog Lake South Access – Met with SD Game, Fish, and Parks, they will mow weeds and remove dead trees. Will have to wait until later this year for tree removal as ground is too soft.

7:30pm – Open sealed bids for lease for grazing land. No bids were received. 

General fund CD in amount of $50,000.00 will be up for renewal August 12. Motion to deposit CD in general fund savings account was made by Grebel, second by Rumpza, all voting aye, motion carried. 

FunFest – Will hold event the third weekend in July in 2015. Will consider two day event next year. Waiting on final bills and donations, currently $4100.00 raised for fund.

7:45pm – Open sealed bids for shop roof repair. No bids were received. 

Nuisance Property – Dennis Gregerson met with Council in regards to property clean up and city ordinances. Discussion was held amongst City Council and community members that were in attendance. Ideas discussed were volunteers to assist in helping others with property cleanup, a complaint form that would be available for residents to file at City Hall in regards to violations of city ordinances. With a greater number of visitors and tourists in the community, we will all benefit by taking pride in our community.

City has received quit-claim deed for the following real estate, Outlot 2 of Outlots 1 through 4, in the Northeast ¼ of the Northeast ¼ of Section 33, Township 122 North, Range 54 West of the 5th P.M. to the City of Waubay.  Motion to serve notice to evict to residents through Attorney Sannes and Sheriff’s Office was made by Moen, second by Jorgenson, all voting aye, motion carried.

Motion to accept the resignation of Dee Aufdencamp with regrets was made by Grebel, second by Rumpza, motion carried. Mayor Jens and Council thanked Dee for her years of service to the Library. Motion to advertise for part-time Librarian position was made by Berger, second by Rumpza, motion carried.

Motion by Moen, second by Grebel, to approve the first reading of 2015 Appropriation Ordinance No. 360, all voting aye, motion carried.

Motion to approve the financial reports for July was made by Jorgenson, second by Berger, all voting aye, motion carried. Cash receipts totaled $120,184.04; General Checking $24,367.58, General Savings $261.81, Library Savings $26.11, Highway 12 Streetlight Savings $1000.00, 2nd Penny Savings  $5032.68, Liquor % $1911.87, WC FunFest $7240.28, Water $10,528.38, Water Savings $0.02, Sewer $9426.24, Sewer Savings $114.25, Sewer Trust $16.44, Utility Deposits $150.00, Construction Acct. $60,108.38.

The next meeting will be held on Wednesday, September 3, 2014 at City Hall at 6:30pm.
